Canada Issues An Update Of Tech Occupations In Global Talent Stream

Canada has issued an Update in the list of occupations that target Category B belonging to the Global Talent Stream.

There was an addition of Computer network technicians as per NOC 2281 in the list, and the removal of engineering managers as per NOC 0211 and architecture/science managers as per NOC 0212. Moreover, there will be changes with effect from July 2019 in the Wage floors.

The Global Talent Occupations List reflects the local labor market and the requirements of ground-breaking companies.

Employment and Social Development Canada stated that it will accept applications for occupations that were axed from the list till Aug 4, 2019. Additionally the Global Talent Stream is popular and also offers work permit processing of only two-weeks in Canada. It has two categories. The Category A is accessed by employers who get the reference from the designated organization. Category B has a focus on a list of top demand occupations related to technology.

GTS: General Requirements

Business must be Legitimate

Employers must provide a proof that they actively engage in the business and need a temporary worker. The business has to provide goods/services relevant to the job offer.

Employers who are new to the TFWP have to submit a document as evidence. Returning employers need not re-submit documents, but will require an additional proof.

The permissible documents are the business license in Canada, forms dealing with legal incorporation, tax papers and finally the attested documents.

Enrollment

Employers must actively hire local persons and permanent residents prior to hiring overseas workers. They   must also describe how this happened.

Wages

Wages must be similar to the prevailing amount that the Canadians and permanent residents receive for such position.

Duties and Working Conditions

Workers specifically hired in the TFWP have to do the job for which they were hired. Overseas workers get the similar cover of laws that govern Canadians and permanent residents. Any Misuse of an overseas worker is a violation of the Canadian law.

  • Provincial /territorial laws cover:
  • Hours of work and overtime,
  • All forms of Compensation
  • Working conditions
  • Employment Termination
  • Safety norms at the Workplace

Also the overseas workers must get the cover of provincial/territorial workplace safety insurance as per law. Any private plan has to match the terms of provincial/territorial plan.

Language Restriction

A job requires English or French while it is in the advertise stage.

Unions and Positions

Wherever a union covers the positions the overseas worker has to receive the same treatment as that of the Canadians or permanent residents covered by the union, for wages and other terms.

Employer Compliance

Employers have to compulsorily comply with general requirements of the TFWP.

Employers in Quebec

From Sep 2017, Quebec employers are in a position of taking the complete advantage of GTS. The Major difference is that employers in Quebec have to submit the application at the same time to ESDC and the Quebec Immigration Ministry.
